Introduction

Welcome to The Recovery Room mobile application ("App"). These Terms of Use ("Terms") are a legal agreement between you ("User," "you," or "your") and Football ConneXions ("Company," "we," "our," or "us"). By accessing or using The Recovery Room App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

The Recovery Room is designed to help athletes of all sports be more conscious and consistent with their recovery habits.

 

Acceptance of Terms

By downloading, installing, and/or using the App, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you must not use the App. We reserve the right to modify these Terms at any time. Continued use of the App following any modifications constitutes acceptance of the revised Terms.

 

Changes to Terms

We reserve the right to modify or update these Terms at any time, in our sole discretion. Any changes will be effective immediately upon posting the revised Terms within the App. We will notify you of any material changes by updating the "Last Updated" date at the beginning of these Terms, and by providing notice through the App or other means. Your continued use of the App after the posting of revised Terms means that you accept and agree to the changes. If you do not agree with any changes, you must stop using the App.

 

User Accounts

To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete, or if you are found to be in violation of these Terms.

 

Use of the App

You agree to use the App in accordance with these Terms and all applicable laws and regulations. You may not:

1. Use the App for any unlawful purpose or in any way that could harm, disable, overburden, or impair the App.
2. Use any robot, spider, or other automated device, process, or means to access the App for any purpose.
3. Use the App to distribute unsolicited promotional or commercial content, or other unwanted or harmful communications.
4. Interfere with or disrupt the integrity or performance of the App or the data contained therein.

You are responsible for obtaining and maintaining any equipment or ancillary services needed to connect to or access the App, including but not limited to internet connections, hardware, software, and other related equipment.

 

User Content

While The Recovery Room app currently does not allow users to create, submit, post, or share content within the app, we may introduce these features in the future. If and when such features are available, any content you create, submit, post, or share ("User Content") will be subject to these Terms. By submitting User Content, you agree to grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the App and content to you and to other users.

Additionally, any content you post on social media platforms tagging or mentioning The Recovery Room may be used by us for promotional purposes. By tagging or mentioning The Recovery Room, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use such content.

 

Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

1. Violating Laws and Rights: Using the App in any way that violates any applicable federal, state, local, or international law or regulation, or that infringes upon the rights of others.
2. Harming the App: Engaging in any activity that could harm, disable, overburden, or impair the proper functioning of the App, including but not limited to introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
3. Unauthorized Access: Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.
4. Automated Use: Using any robot, spider, scraper, or other automated means to access the App for any purpose without our express written permission.
5. Fraud and Deception: Engaging in any activity that involves fraudulent or deceptive practices.
6. Unauthorized Data Collection: Collecting or harvesting any information from the App, including, but not limited to, other users' personal information, without proper consent.

Violation of any of the above may result in immediate termination of your access to the App, and may also expose you to civil or criminal penalties.

 

Intellectual Property Rights

All content and materials available on the App, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of The Recovery Room and are protected by applicable copyright, trademark, and other intellectual property laws. Any unauthorized use, including but not limited to the reproduction, distribution, display, or transmission of any content on the App, is strictly prohibited unless specifically authorized by The Recovery Room.

 

Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the App. By using the App, you consent to our collection and use of your information as outlined in the Privacy Policy.

 

Disclaimers and Limitation of Liability

The App is provided on an "as is" and "as available" basis. The Recovery Room makes no warranties, expressed or implied, regarding the operation or availability of the App, or the information, content, and materials included on the App.

To the fullest extent permitted by applicable law, The Recovery Room disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The Recovery Room does not warrant that the App, its servers, or emails sent from The Recovery Room are free of viruses or other harmful components.

The Recovery Room will not be liable for any damages of any kind arising from the use of the App, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

 

Termination

We reserve the right to terminate or suspend your account and access to the App, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Australia for the resolution of any disputes arising out of or relating to these Terms or the App.
